The victim, Victor Jerez, was taken to ECMC with multiple injuries, but was released from the hospital. He actually told the court that he last recalled walking across Letchworth Street before he was struck.
Another witness said they were all at the Fubar Bar near the Buff State campus when a fight broke out and security urged everyone to get out. The woman testified that someone mentioned a gun. She said the crowd scattered and she saw Gbaraba run to his silver Impala parked nearby. She said she saw that car accelerate and said it almost struck another car before she saw it strike Jerez.
Jerez, a student at Buffalo State College, did not want to talk on camera but said he is doing well, despite some bumps and bruises. He said he is still in pain, and he suffered a fracture to his face.
A city court judge set Gbaraba's bail at $75,000.
